Every Q4, outside agencies and non-specialized IP firms pop up promising brands they can "clean up unauthorized sellers in 48 hours."
Be very careful who you hand the keys to your Brand Registry tools.
Amazonians have confirmed to me that they are tracking external service providers and "law firms" who submit sloppy, blanket counterfeit or unsubstantiated claims against legitimate resellers or distributors who simply aren't on an authorized dealer list.
It's hyper-aggressive, overreach and though it may sound sexy and exciting in a presentation, it can hurt.
IP claims abuse or bogus complaint-based attackers are definitely sitting in the Amazon crosshairs.
For some reason, certain brand owners love taking this risk, and/or risking a negative outcome. I assume they don't love punishment and discipline.
Here is what happens when your agency/ provider/ lawyer gets reckless:
Filing a counterfeit or IP complaint against an authentic product just to enforce 'preferred pricing' violates Amazon's policies. And, potentially, they resent being used as a tool to takeout competition, even if you're a rightful brand owner who is reporting "unauthorized resellers."
Amazon can flag your account for bad-faith reporting, and they'll be unhappy if they warned you for it already and you just do it again anyway.
If you submit several, they may strip your Brand Registry privileges entirely. Messaging from Amazon abounds on seller group threads.
Either way, you don't want to be in a subservient position, dependent on mercy or forgiveness...all because you listened to the wrong sales pitch.
Imagine heading into Cyber 5 unable to run Sponsored Brands, update A+ content, or report actual counterfeiters because your third-party agency got trigger-happy.
It could wipe away your whole Q4 strategy.
You cannot outsource your accountability, or sacrifice your credibility as a legitimate seller. If an agency represents your brand in Brand Registry, audit every single submission they make before they press send.
