Two criteria suddenly matter, and they were not measured by EAA.
Both will be measurable with EN 301 549 from 1st August.
✅ Adequate size = x-height of at least 2.4mm
✅ Sufficient contrast = meets WCAG standards
WHAT CREATIVE ASSETS ARE AFFECTED
→ Secondary PDP Gallery images on EU retailers (especially Amazon)
→ Brand .com websites with "Buy Now" buttons
→ Retailer Media Banners
If your website has a path to purchase, it's likely in scope.
💥WHY THIS MATTERS: THE TOUGH NEWS💥
For the first time, regulators will have an objective standard to test against.
No more "we think it's fine."
No more eyeballing it on a desktop monitor.
If your text doesn't meet 2.4mm x-height and sufficient contrast, it fails.
Simple. Brutal. Measurable.
Failures in contrast and text size are high-visibility "low-hanging fruit" for regulators. French retailers are already facing litigation for this under EAA.
Retailers could simply take down all secondary images that haven't been proven to meet the EAA EN 301549 technical requirements.
