Walmart's about to get billions back for tariffs the Supreme Court already ruled illegal.
You paid the same tariffs.
Guess who's actually getting the check.
A federal portal opened today to claim back over $160 billion in refunds.
The projected payouts: $10.2 billion to Walmart. $2.2 billion to Target. $1 billion to Nike. $550 million to Kohl’s. $540 million to Home Depot. $400 million to Gap.
But the real story isn't who's getting a check. It's what they do with it.
Management teams are publicly talking about buybacks, debt paydown, and "cash cushions."

Walmart Marketplace has been pulling third-party sellers off Amazon. Walmart+ is eating into Prime. Walmart just partnered with OpenAI on agentic commerce.
$10.2 billion doesn't sit still at a company in growth mode.
Some of it funds marketplace expansion. Some of it subsidizes seller fees. Some of it funds Walmart Connect advertising.
And then there's the other shoe.
The tariffs the Supreme Court struck down were imposed under emergency authority; that's what got ruled illegal.
Section 301 is a different, older law. It lets the administration reimpose tariffs through a formal USTR investigation. Slower to stand up. Much harder to strike down.
Treasury Secretary Bessent said last week those investigations are already running. Tariffs could be back at the previous levels by July.
The refund isn't tariff relief. It's a cash event in the window before tariffs come back through a stronger legal door.
Amazon's third-party sellers paid the same tariffs, but most won't see a refund.
To claim through CAPE, you have to be the importer of record. If you bought DDP from an overseas supplier or sourced through a U.S. distributor, the refund flows to whoever's name was on the import. Not yours.
And even the sellers who ARE importers of record are filing for refunds on a fraction of the volume Walmart and Target just moved through the portal.
Same tariffs coming back. No cushion on the other side.
The retailers big enough to efficiently claim these refunds get a one-time capital injection right before the next tariff cycle.
Everyone else just gets the cycle.
