The Supreme Court just ruled Trump's tariff strategy unconstitutional.

And within hours, he announced a new one.

The Court struck down IEEPA as the legal basis for tariffs 6-3.

Immediately after the ruling, Yale’s Budget Lab estimated the effective US tariff rate would drop from 16.9% to 9.1%.

Then Trump immediately layered on a fresh 10% GLOBAL tariff. One that can run 150 days without congressional approval.

Section 232 tariffs on steel, aluminum, and autos still stand. The new 10% is now sitting on top of all of it.

And there's a brewing fight over whether the government has to refund billions already collected.

While Washington is debating the statutory authority, sellers should be modeling survival scenarios.

Here's what I would do immediately:

1) Model your tariff scenarios at 10%, 20%, and 30% COGS increases. Know your margin floor before you need it.

2) Map your retail pricing lag. If Walmart and Target need 60-90 days' notice for price increases, your Amazon Buy Box is at risk the second your costs spike.

3) Stress-test your cash position. Longer tariff windows mean longer exposure periods. 150 days is not nothing.

4) Watch the refund fight closely. If billions get clawed back from collected tariffs, the repricing chaos that follows will be fast and brutal.

I've watched good brands get wiped out this year because they were reactive instead of prepared.

The legal fight over who controls tariffs will drag on for months.
